4. Make a Comparative Study of the Constitutional System of UK and USA.

The United Kingdom and the United States of America are two important democratic countries of the world. Both countries believe in democracy, rule of law, constitutional government, and protection of citizens' rights. However, their constitutional systems differ in many important aspects. The Constitution of the United Kingdom has developed gradually through customs, conventions, statutes, and judicial decisions, whereas the Constitution of the United States is written and enacted in a single document.

The constitutional system of the United Kingdom is parliamentary in nature, while the constitutional system of the United States is presidential in character. A comparative study of these two constitutional systems helps us understand the different methods of democratic governance adopted by these countries.

Meaning of Constitutional System

A constitutional system refers to the structure, principles, rules, and institutions through which a country is governed. It determines the powers and functions of different organs of government and defines the relationship between the government and the citizens.

Comparative Study of the Constitutional System of UK and USA

One of the most important differences between the constitutional systems of the United Kingdom and the United States is related to the nature of the Constitution. The Constitution of the United Kingdom is mostly unwritten and flexible. It is based on conventions, customs, statutes, judicial decisions, and historical documents. On the other hand, the Constitution of the United States is written and rigid. It was framed in 1787 and exists in the form of a single written document.

Another major difference is regarding the form of government. The United Kingdom follows the parliamentary form of government, whereas the United States follows the presidential form of government.

In the United Kingdom, there are two executives β€” the nominal executive and the real executive. The King or Queen is the nominal executive, while the Prime Minister is the real executive. In the United States, the President is both the nominal and real executive.

The relationship between the executive and legislature is also different in the two countries. In the United Kingdom, the executive and legislature are closely connected because ministers are members of Parliament. In the United States, there is a clear separation of powers between the executive and legislature.

The British Parliament is sovereign and supreme. It can make or repeal any law according to its wishes. No court can declare an Act of Parliament unconstitutional. In contrast, the American Constitution is supreme. All organs of government including Congress are bound by the Constitution, and the Supreme Court can declare laws unconstitutional.

Another important difference is related to the legislature. The British Parliament consists of two houses β€” the House of Commons and the House of Lords. The American Congress also consists of two houses β€” the House of Representatives and the Senate.

The lower house in Britain is called the House of Commons, which is more powerful than the House of Lords. In the United States, both houses of Congress are powerful, especially the Senate which plays an important role in law-making and appointments.

The party system in the two countries also differs in certain respects. The United Kingdom mainly follows strict party discipline. Members of Parliament generally obey party decisions. In the United States, party discipline is comparatively weak, and members of Congress often vote independently.

The judiciary occupies different positions in the two constitutional systems. In the United Kingdom, the judiciary does not possess the power of judicial review in the same way as the United States. In the United States, the Supreme Court has the power to interpret the Constitution and declare laws unconstitutional.

Another major difference is regarding federalism. The United Kingdom has a unitary system of government in which powers are concentrated mainly in the central government. The United States has a federal system where powers are divided between the federal government and state governments.

The amendment process of the Constitution also differs in both countries. The British Constitution is flexible and can be amended through ordinary law-making procedures. The American Constitution is rigid and amendment requires a special procedure with approval by Congress and the states.

The position of the head of state is also different. In the United Kingdom, the King or Queen occupies the hereditary position of constitutional monarch. In the United States, the President is elected for a fixed term.

The tenure of the executive is another point of difference. In the United Kingdom, the Prime Minister and the cabinet remain in office only as long as they enjoy majority support in Parliament. In the United States, the President enjoys a fixed tenure of four years.

The cabinet system also differs in both countries. In Britain, the cabinet is collectively responsible to Parliament. In America, the President’s cabinet members are responsible to the President and not to Congress.

The role of conventions is highly important in the British constitutional system. Many constitutional practices are based on conventions. In the United States, constitutional conventions are less important because most constitutional rules are written in the Constitution itself.

Similarities between UK and USA

Despite many differences, both countries share certain similarities. Both believe in democracy, representative government, protection of rights, independence of judiciary, and rule of law. Both countries also follow bicameral legislature and respect constitutional governance.

Conclusion

The constitutional systems of the United Kingdom and the United States represent two different democratic models. The British system emphasizes parliamentary sovereignty and cabinet government, whereas the American system emphasizes constitutional supremacy and separation of powers. 5. What do you mean by Conventions? Make the differences between Laws and Conventions. What are the sanctions behind conventions in the British political system?

They are not enforced by courts of law, yet they are considered binding because they are accepted and followed by political leaders and constitutional authorities.

Conventions play a very important role in the British political system. The British Constitution is largely unwritten, and therefore conventions help in the smooth functioning of government. Many important constitutional practices in Britain are based on conventions rather than written laws.

For example, the King or Queen appoints the leader of the majority party in the House of Commons as the Prime Minister. Similarly, the monarch acts according to the advice of the Prime Minister and the Cabinet. These practices are not written in law but are followed as constitutional conventions.

Differences between Laws and Conventions

The first difference between laws and conventions is related to their nature. Laws are written rules formally enacted by the legislature, while conventions are unwritten customs and practices developed through long political experience.

Another important difference is regarding legal enforceability. Laws are enforceable by courts of law. Any person violating the law may be punished by the courts. Conventions, on the other hand, are not enforceable by courts because they are not legal rules.

Laws possess legal authority and are officially recognized by the state. Conventions derive their authority from public opinion, political morality, and constitutional traditions.

The violation of laws results in legal punishment. A person breaking the law may face fine, imprisonment, or other legal action. But violation of conventions generally results in political criticism, public disapproval, or constitutional crisis rather than legal punishment.

Laws are made through a formal legislative process by Parliament or other legislative bodies. Conventions develop gradually through continuous political practice and usage over a long period of time.
